The ANC government has chosen to walk in the footsteps of other corrupt post-colonial African leaders and they have million of supporters in those deals.   Large-scale corruption is often framed around the liberation struggle rhetoric of empowering black people but blame “apartheid”, while apartheid was created under British empire and with Khoi san and Black leaders after Mfecane (Shepstone 1854) – the so-called apartheid system – it is still ongoing with separate CPA and Trustlands with leaders. The reality is that the black elite enrich themselves, their own agendae and their families through government tenders and other questionable and unethical means.

South Africa has a bicameral Parliament (two Houses) supported by a joint administration. The National Assembly is the House directly elected by the voters, while the National Council of Provinces is elected by the provinces and represents them to ensure that provincial interests are taken into account in the national sphere of government.

The National Assembly has 400 members. The number of seats that a party has in the Assembly is in proportion to the number of voters that voted for it in the elections.

Enige president van Suid-Afrika het eerstens ‘n verantwoordelikheid teenoor die land en al sy burgers, hetsy of hulle die ANC ondersteun of nie.  Dit behels die ekonomie, finansies, maatskaplik, kultureel en op elke gebied is dit die ANC wat verantwoordelikheid moet dra vir alles.  Dit sluit alle staatsentiteite in, wat in 1994 almal met ‘n goed geoliede masjien gewerk het. 

Die huidige strukture en salarisse trek beslis aan geen kortste end om al die verantwoordelikhede nie na te kom nie, veral as na sy groot korps gekyk word.

Die GOEDBETAALDE ministers en adjunk ministers word aangestel wat elke faset bedryf en moet toesien dat iets soos misdaad en korrupsie nie plaasvind nie.     Tans word dit nie eerbiedig nie.  In SA is die grootste party die kommunistiese ANC wat beslis geen toegevoegde waarde byvoeg sedert 1994 nie, maar afwaarts afgehel het na rommel en swakker status.   

Onder hulle volg die hele hiërargie van Departemente, Provinsies, Munisipaliteite, Tradisionele leiers wat blankes toetaal en al uitsluit weens die kleur van hul vel en swart bemagtiging,   Almal deel in hierdie groot uitspattige lewenstyl wat hul vir hulself beding het.

Wetgewing (lees met Grondwet)

Al die wetgewings word met mede en ander partylede gekoukus, ondersoek en geïmplementeer.   Swart bemagtiging en onteiening is deel hiervan om ons nog verder af te trek, want dit is teen internasionale regs.  Korrupsie en misdaad word deur die huidige regering en hul opposisies toegelaat want bitter weinig word daaraan gedoen, veral die grootskaalse korrupsie wat eenvoudig soos ‘n tenniswedstryd plaasvind.   Alles word aangehoor, bekendgemaak maar min of geen vervolgings is aan die orde van die dag.  Opposisies skryf ook wetgewings wat deurgaan terwyl ander soos swart bemagtiging ondersteun is.

Opinie en kwelvrae

Daar is soveel onwillekeurige vrae, stellings of opinies na die sogenaamde “onafhanklike” grondwet, wat net soms nooit sin maak vir burgers nie. veral met die oog op die gebeure rondom die Gupta saga en ook ander korrupsie op hoë vlakke.   

Die feit dat daar soveel ANC, EFF, DA en ander politieke ondersteuners hiervoor gestem het en steeds stem, is nogal kommerwekkend dat daar vir ekonomiese verval en rewolusie gestem word.  Die teendeel is waar, indien die ondersteuners nie tevrede is met die gebeure nie, waarom dan vir partye stem wat slegs sekeres (elite) daaruit voordeel trek? 

President

Presidente van ‘n land, saam sy/haar ministers het ‘n direkte verantwoordelikheid teenoor elke burger van die land, lenings en ooreenkomste wat aangegaan word met buitelandse partye en wetgewing wat rassisties is in Suid-Afrika en teenoor slegs blankes diskrimineer.

Demokrasie en regsbank

Eerstens word bevraagteken of ons in Suid-Afrika regtig ‘n demokratiese regering of onafhanklike regstelsel sedert die aanvaarding van die 1996 Grondwet het. 

Tweedens gaan die direkte invloed van aanstellings van regters en kommissies in terme van die 1996 Grondwet deur die President van die land en diegene wat hom daarin bystaan, ‘n groot impak veroorsaak op die algehele misdaad en veral korrupsie op staatsvlakke wat al sedert 1994 hoogty vier. 

Hoe kan persone soveel mag hê, nie net in die parlement nie, maar moontlik tot ‘n sogenaamde onafhanklike regsbank, aangesien die president hoof is van die meerderheid politieke party en nog die bepalende faktor wees wat die korrupsie aanhoor of moet verhoor – sy bydrae tot aanstellings van die regsbank.  Dit wil sê, sake kan so lank as moontlik sloer net om te vergeet van sake van die verlede wat die land finansieel kos en ekonomies verwoes.   Verwysende na al die staatsentiteite soos SAL wat bankrot gaan of soos Eskom wat nie die nodige elektrisiteit voorsien nie, asook na groot korrupsie sake soos wapenskandaal, teksboeke, treine, e-tol, ensovoorts, waar bittermin vervolgings plaasvind

Derdens moet die hele Grondwet gelees word met toepaslike wetgewings en kan gesien word hoeveel miljoene word bestee op die regsbank waar sake eenvoudig te lank sloer alvorens daar ooit ‘n uitspraak gemaak word, veral op die vlak waar groot staatskorrupsie gepleeg word. 

Vierdens word daar na normale misdaadvlakke gekyk wat net nooit die nodige aandag geniet soos dit hoort nie.   Soos onder andere moorde, plaasmoorde, politieke moorde, faksie geweld, bende geweld waar sterftes is of selfs gesinsgeweld en die smokkel van kinders, mense en organe.   

Daar is heelwat gevalle waar daar nie ordentlike misdaad ondersoeke gedoen word op toneel van misdaad nie.   Na lang gesloer word sake eenvoudig uitgegooi weens gebrek aan kennis of inligting.    Ook hieronder val die misdaad teenoor omgewing, mineraalbedrywighede, besoedeling en diere soos die smokkel in renosterhorings.     

Onwillekeurig is daar bypassende vraag hoeveel onopgeloste sake is daar op alle vlakke?

Daar was voor Zuma aangestel is as president, ook heelwat korrupsie wat gepleeg is en eenvoudig aangegaan het om te gebeur.

As voorbeeld, Zuma het op 9 Mei 2009 president geword tot en met sy bedanking op 14 Februarie 2018.   Onder wie het die groot kaping en Gupta “ekonomiese slagting” plaasgevind? Ten spyte dat daar min fondse teruggevind is, verdien al hierdie “meester breine” miljoene rande” salarisse, en kan met opreg gevra word, waarvoor?

Aanstelling van regterlike beamptes

(4) Die ander regters van die Konstitusionele Hof word deur die President, as hoof van die nasionale uitvoerende gesag, na oorleg met die Hoofregter en die leiers van partye wat in die Nasionale Vergadering verteenwoordig is, ooreenkomstig die
volgende prosedure aangestel:

(a) Die Regterlike Dienskommissie moet ʼn lys van benoemdes opstel met drie name meer as die getal aanstellings wat gedoen moet word, en die lys aan die President voorlê.

(b) Die President kan aanstellings uit die lys doen, en moet die Regterlike Dienskommissie in kennis stel, met vermelding van redes, indien enige van die benoemdes onaanvaarbaar is en enige aanstelling nog gedoen moet word.

(c) Die Regterlike Dienskommissie moet die lys met verdere benoemdes aanvul en die President moet die oorblywende aanstellings uit die aangevulde lys doen.

Voorbeeld – Example

Invloede van buite die regsbank of is dit persoonlik van aard of wie sit hieragter – daar is nie ‘n patroon nie, dit is die regskostes en inkomstes wat in ‘n saak ingaan? Die Regsbank moet juis totaal en al onafhanklik wees en optree.

Watse tipe regsgelde is hierby betrokke en waar gaan alles heen? Die aanhoor en uiteindelik uitspraak van enige hofsaak, hetsy erge misdaad, moord of korrupsie moet so gou doenlik geskied – waarom word daar jare gesloer hiermee.

Dis eintlik onregverdig dat so iets in die openbaar gevra word, want dit word nie aan enige ander misdadiger gestel oor watter tipe straf moet gegee word nie. Weet die regters dan glad nie as hul dit vra of gaan dit oor tydsverloop van hofsake en kostes van die regsbank? Met ‘n onafhanklike regsbank, behoort steeds verwag te word dat een misdadiger nie voorkeur kry bo ‘n ander een nie en dat geen regter so ‘n vraag sou stel nie, want indien daar geen oortreding begaan is nie, sal daar geen uitspraak wees nie. Daar is biljoene korrupsie gepleeg onder sy beheer en behoort persone daarvoor verantwoordelik gehou te word. Waarom regters en kommissies eerstens aanstel met sulke ernstige oortredings – geen wonder die land se ekonomie lyk soos dit lyk nie. En kom die vrae op wie die aanstellings beheer. Hoe kan dit hoegenaamd onafhanklik wees? Geld so iets nie vir alle korrupsie nie?

13 April 2021 (MALEMA)

The KwaZulu-Natal judge Dhaya Pillay found herself defending her private financial investments, her “friendship” with Pravin Gordhan and a lunch she had with Jacob Zuma at his homestead in Nkandla during her interview with the Judicial Services Commission.

She revealed how she helped with drafting the constitution, the country’s post-democracy labour laws and sits on the Electoral Commission of SA (IEC) — she found herself being questioned about her personal financial affairs and the fact that she is a director of two “investment” vehicles, which she declared on the judges’ assets register.

She was faced with questions about her presiding over the matter in which Derek Hanekom successfully sued former president Jacob Zuma for defamation and when she presided over Zuma’s criminal case in Pietermaritzburg when she issued a stayed warrant for his arrest for his non-appearance. She said a crisis occurs where public office bearers pronounce that they are not bound by the constitution and refuse to obey court orders.

Malema said he will argue in the closed session about her position.

Hoe lank sloer die sages met Zuma nie al nie – dit word ‘n lang en duursame regsproses en wie moet al die onkostes daarvoor dra, hetsy skuldig of nie?

ConCourt swiftly dismisses Zuma’s ‘State of Capture’ case, slaps him with huge legal bill – 27 May 2021. (A*)

It was stated they are in a strange situation where the applicant (Zuma) for leave to appeal has not complied with any of the court’s directives. No record of appeal has been filed. And in consequence thereof, no heads have been submitted either by the applicant himself and certainly not by the respondents, was said by advocate Kameel Premhid representing the Economic Freedom Fighters.

The Acting Deputy Chief Justice Sisi Khampepe adjourned the case for a few minutes and returned to rule that the case be struck off the roll with costs. The ruling will see Zuma not only having to pay the legal fees for all parties involved in the case, but also the legal fees in the High Court and Supreme Court of Appeal (SCA) cases that he had initially gone to before the ConCourt.

Korrupsie – Belastingontduiking en vrae in Parlement

As president van ‘n sogenaamde “demokratiese regering” is meeste van hierdie uitgawes toegelaat omdat hulle dit wil toelaat – hofsake sloer en strek oor dekades heen, sonder vervolgings.

Ekstra inkomstes vir diegene (korrupsie) wat dit neem, word nie as belastinginkomste gesien nie. Daar is al geruime tyd vrae gevra in die parlement oor die tendens van finansiële implikasies vir die belastingbetalers. Alles word in Hansard genoem en selfs in die media verskyn artikels hieroor dit miljoene beloop. Steeds gaan die korrupsie aan. Die regering, by implikasie ook die president is verantwoordelik vir die staatsentiteite en hul belange, veral die pensioenfondse wat so misbruik is.

Eskom

Selfs Eskom word genoem, en dan kan Eskom nie voorbly om ons verder te belas met hoër tariewe vir elektrisiteit en voorsiening nie. Enige president moet en behoort verantwoordelikheid te neem vir hul dade en ook die ministers wat hul aanstel wat deel vorm van hul kabinet.

FINANCIAL COSTS – THOSE NOT THE ONLY ONES – WHO PAID IT?

Opposition parties pushed for the release of the figures in parliamentary questions and civil court action. In October 2017, in response to a DA question, President Cyril Ramaphosa told Parliament the costs were R15.3-million for the period 2005 to 2016.

Yet, according to two civil litigation judgments in cases brought by the DA and the EFF in December 2018 in the North Gauteng High Court and the SCA in April 2021, Zuma racked up personal legal fees and cost orders of at least R25-million.

Zuma was president from 2009 to 2018, but the state was still, theoretically, paying his legal fees until April this year, when the SCA confirmed the high court order that this was “unlawful, unconstitutional and invalid”. The cost of opposing this litigation has yet to be quantified.

The SCA said it was emerged that the State Attorney paid all of Mr Zuma’s legal costs; that is, Hulley Inc’s fees [Michael Hulley, Zuma’s then attorney] and disbursements including counsel’s fees, as well as the costs of his opponents when so ordered…”

The judgment lists costs totalling R24.9-million, in these cases:

“(a) unsuccessfully seeking to set aside certain search and seizure warrants issued in October 2005 (R9 676 176);

“(b) unsuccessfully seeking to set aside a request for co-operation from Mauritian authorities made in April 2007 (R4 791 437);

“(c) unsuccessfully seeking to set aside the 2007 indictment (R2 649 512);

“(d) unsuccessfully opposing the DA’s review of the 2009 decision to discontinue the prosecution (approximately R7.8 million)”.

On 27 May 2021 it was stated that Zuma will have to pay up to R10m after the Constitutional Court struck from the roll with costs his legal challenge against the personal cost order against him over his attempt to challenge the public protector’s “state of capture” report.

Previously was stated that Madonsela had recommended that Zuma appoint a commission of inquiry into allegations of state capture and that it be headed by a judge selected by chief justice Mogoeng Mogoeng. Zuma had rejected the recommendation and argued that the report was unconstitutional as he said establishing a commission of inquiry and selecting its presiding officer was his presidential prerogative in terms of the constitution. The high court however ruled that Madonsela had the power to direct Zuma to appoint a commission of inquiry and to direct that Mogoeng selects its chairperson, as Zuma was conflicted, personally implicated in the allegations of state capture and had personal interest in the outcomes of the inquiry.

The EFF, DA and the Council for the Advancement of the South African constitution (Casac), who had joined the matter as friends of the court, argued for the matter to be struck off the roll with costs as Zuma failed to file heads of arguments and the appeal record. Deputy chief justice Sisi Khampepe announced that the matter was struck off the roll with costs, which was a further blow to Zuma, who is still fighting against the court order that he pays back about R25m in legal fees which had been footed by the state in his arms deal corruption trial.

Zuma may just have tied the ConCourt in knots …

Some reader wrote in Soweton Live that 12 jurors have been seen in the Derek Chauvin trial for the murder of George Floyd took less than 12 hours to render a verdict of guilty in all three charges in a case more complicated (in terms of the volume of technical and legal minutiae) than that of Zuma at the ConCourt. And it was more than three months that SA distinguished jurists have been struggling with the case(s) of Zuma. What could be the reason for that? Is that even possible to compare this (crime) situation(s) in SA with those happening America? It was further stated by Ngcukaitobi that Zuma’s was a case of him ignoring all proceedings before the ConCourt; that his was a cynical ploy to avoid accountability.  The summons and court order have to be obeyed was said the advocate.

COVID CORRUPTION UNDER ANC GOVERNMENT

Corruption-weary citizens were given a faint ray of hope when Cyril Ramaphosa replaced the disastrous Jacob Zuma as State President in 2018. Ramaphosa’s “New Dawn” promise, however, turned out to be a non-starter due to relentless ANC corruption, theft, fraud, racketeering, and money laundering. Not even the Covid-19 relief funds – meant for the poor and jobless – were spared. While more than fifty percent of households struggle to feed themselves, billions have been looted by politically connected fraudsters.

A reported R22 billion of the R500 billion emergency relief budget is already missing. Ramaphosa assured the nation government will focus on fighting the Covid-19 pandemic. Who could have imagined that ANC corruption, and not lockdown transgressions, would undermine the fight against Covid-19? Incredibly, thousands of citizens were arrested for contravening lockdown regulations but not one single ANC cadre has faced justice for their despicable crimes against the people of South Africa.

The International Monetary Fund (IMF) granted government a R70 billion loan to supplement rapidly dwindling public coffers. South Africa is drowning in debt, which is expected to exceed 100 percent of GDP by 2024. Ramaphosa announced the creation of a multi-agency law-enforcement and prosecutorial task force to ostensibly combat the rampant corruption in his party. However, most analysts believe the announcement was meant to appease the concerns of international lenders. But why establish another mechanism to investigate corrupt public officials when mountains of Zondo Commission evidence – implicating ANC officials in corruption already exists? The Commission costs tax-payers almost R1 billion to date, with nothing to show for it.

Shortly after his announcement, Ramaphosa’s spokesperson, Khusela Diko, her husband and Gauteng Health MEC, Bandile Masuku were implicated in a R125 million PPE scandal. Almost every aspect of governance is now tainted with corruption. Sam Vukela, the Director General of the Department of Public Works was suspended for “inflating the costs of state funerals”. Apparently 3 funerals cost tax-payers R76 million! The Eastern Cape province, that already collapsed under ANC corruption and maladministration, is now implicated in a dodgy R160 million contract with ANC benefactor, Iqbal Surve, who himself is implicated in massive PIC linked corruption worth billions.

102 Companies in Gauteng alone are being investigated for tender fraud. Add the hundreds of billions looted during the disastrous “State Capture” scandal and the numbers are truly staggering. Personal Protective Equipment (PPE) was procured for frontline healthcare workers fighting the pandemic. Tragically, ANC PPE tender fraud has seriously undermined the fight against Covid-19 and rendered healthcare workers vulnerable to infections and even death.

To understand the scale of the widespread fraud and theft currently decimating South Africa, government loaned R70 billion in emergency funds to plug the holes. But ANC run municipalities wasted R32 billion in just one year with zero accountability for its actions.
