Land expropriation without compensation

Ramaphosa, his cabinet and members of parliament, as well as opposition, like Malema are farmers do have farms.    Can they lead by example and donate some of their land to the poor.   They can also mentor and show them how to farm those land, their own blood brothers.   Make sure there are enough animals, trucks and implements to farm with.  In 1994 the ANC received all the SOE’s in a working state, today they are all gone and empty.   The state and municipalities are gone.   Those SOE’s and municipalities, the government, must go back to the people that can do the work, not the B-BBEE’s that don’t know what to do.  Where are the 5000 farms the anc bought since 1994 to do expropriation?

The ANC is seeking established farmers to donate some of their land to speed up Land Reform and Redistribution in South Africa. In a leaked Economic Transformation Sub-Committee Policy Proposal Document of the ANC, a Land Reform and Agricultural Agency being formed by the Department of Land Affairs would run this program. The ANC’s proposal comes at a time when the governing party is preparing for its Policy Conference in June after failing to change Section 25 of the Constitution to be explicit on Land Expropriation Without Compensation.

The ANCs National Executive Committee considered new policy proposals this weekend. Among them is a proposal that farmers be asked to donate unused land to black emerging farmers. In 2017, the party resolved that it would seek land expropriations without compensation. But last year it failed to pass a bill through parliament to effect this due to the EFF’s insistence that the state becomes the custodian of the land.

The ruling ANC wants farmers to donate land for redistribution to emerging black farmers as part of a significant shift in land expropriation policy. The proposal is found in a discussion document prepared for the party’s policy conference scheduled for July, the Sunday Times reports.

The proposal is a marked change from the party’s previous plans to amend the Constitution to allow for land expropriation without compensation in a legal framework. Instead, it proposes that a ‘land reform and agricultural development agency’ be established.

This agency will be responsible for:

  • Enabling policy and bureaucratic processes to facilitate land donations;
  • Creating and managing a recognition mechanism given to farmers donating land;
  • Providing financial support to beneficiary farmers; and
  • Developing programmes to assist new farmers with market access and to develop skills across the entire agricultural value chain.
  • Managing state-owned land earmarked for distribution and the process of land donations.

The agency will only record land transactions and accept land for redistribution. The policy document states that this will encourage the voluntary release of land by mines, churches, municipalities, SOEs, government departments or absentee landlords directly to beneficiary households, communities or the agency.

Failed attempt

The drastic shift in policy comes after the ANC failed to secure sufficient backing from the opposition to amend the Constitution.

However, justice minister Ronald Lamola said that the party would not be deterred in its plans for land expropriation and will now resort to using regular legislation to facilitate the process.

“Changing the Constitution was just one instrument we could have used,” he said in a December interview. “The matter is now ended. We will now use our simple majority to pass laws that will allow for expropriation without compensation.”

Most opposition parties warned that the ANC’s proposals would undermine property rights and investor confidence, while the populist Economic Freedom Fighters said they didn’t go far enough.

The ANC decided in 2016 that constitutional changes were needed to address racially skewed land-ownership patterns dating back to white minority rule. While some legal experts said land seizures were already permissible, the party argued that the issue should be addressed more explicitly.

ANC plans to introduce land expropriation in South Africa without Constitution change: minister

South Africa’s ruling party has scrapped plans to change the constitution to make it easier for the state to take land without paying for it after failing to secure sufficient backing from the opposition and will now resort to using regular legislation to facilitate the process.

“Changing the constitution was just one instrument we could have used,” Justice Minister Ronald Lamola said in an online interview. “The matter is now ended. We will now use our simple majority to pass laws that will allow for expropriation without compensation.”

The African National Congress decided four years ago that constitutional changes were needed to address racially skewed land-ownership patterns dating back to colonial and white minority rule. While some legal experts said land seizures were already permissible, the party argued that the issue needed to be addressed more explicitly.

Most opposition parties warned that the ANC’s proposals would undermine property rights and investor confidence, while the populist Economic Freedom Fighters said they didn’t go far enough.

The ruling party controls 58% of the 400 seats in the National Assembly, and more than a third of lawmakers rejected its proposed constitutional amendment bill on Tuesday.

Most land remains in the hands of the white minority and the status quo is unsustainable, posing a threat to national stability, according to Lamola.

“We need to have fair and equitable land redistribution,” he said. “While a lot of the land redistribution has centred on rural areas, the real need is in the semi-urban and urban areas.”

The initial focus will be on completing the parliamentary process to pass the Expropriation Amendment Act Bill, which will enable the state to expropriate land provided that public interest and other requirements are met.

Two other proposed property laws are in the making: A Land Distribution Act that regulate land distribution in semi-urban and urban areas and a Communal Land Rights Act that will give security of tenure to those living in areas controlled by traditional leaders.

LAND EXPROPRIATION IS THAT THE WHOLE OF AFRICAN COUNTRIES CAN STAY HERE IN SOUTH AFRICA FOR FREE TO GET EVERYTHING FREE

LAND EXPROPRIATION

Policy and actually resolved that the notion of land expropriation without compensation is part of the tool kit of the ANC in seeking to redress the troubled land question.

We must stop being cowards. We must stop walking on eggshells around white minorities who are governed by the fear of the unknown when it comes to the question of land expropriation without compensation.

In the 1994 elections, the PAC’s slogan was land first and all shall follow; we were ignored. The PAC manifesto also said there shall be land expropriation without compensation except compensation for improvements made on the farm,   not for the land itself. Well, two decades later, we seem to be making progress.
