Swart bemagtiging – Chinese – B-BBEE legislation

Die Chinese is volgens die hofuitspraak van 2008 geregtig op swart bemagtiging en moet ingesluit wees in “voordele” soos die ander volke.    Gedurende hierdie jaar het die Suid-Afrikaanse Hooggeregshof in Pretoria beslis dat die Suid-Afrikaanse Chinese gemeenskap “swart” is in terme van Gelyke Indiensneming en Breë-gebaseerde Swart Ekonomiese Bemagtiging.

Dit was die resultaat van ‘n agt jaar lange stryd wat deur die Chinese Vereniging van Suid-Afrika van stapel gestuur is om hul status in terme van regstellende aksie en bemagtigingswetgewing duidelik te maak.   Wanneer daar na veral werksgeleenthede gekyk word, word selfs Brics lande uitgenooi om deel te wees van swart bemagtiging en regstellende aksie wetgewings in Suid-Afrika.   

DISKRIMINASIE EN RASSISME

Regter Cynthia Pretorius het ‘n bevel toegestaan gedurende 2008, ingevolge waarvan Chinese Suid-Afrikaners ingesluit word by die definisie van “swart mense” in die Wet op Breë-gebaseerde Ekonomiese Bemagtiging en die Wet op Gelyke Indiensneming.

Albei wetgewings dek Swartes,  Khoi san en Indiërs. Geen blankes is ingesluit in die wette oor ekonomiebemagtiging of billike indiensneming nie. Selfs sportkwotas is teen blankes ingestel en ander was goed om die speletjies te speel.    Diegene in beheer was verblydend oor die brokkies nuus dat ook Chinese soos ander etniese rasgroepe, nou voorkeur geniet bo Boere en blankes,   Inteendeel blankes verlaat die land vir beter geleenthede omdat hulle nie die geleenthede hier kry nie.

Dit was die Britse regering wat reeds voor 1910 apartheidswetgewing ingestel het, net nadat hulle koloniale gebiede geannekseer het in 1800.   Swartes het nie grondgebiede aangekoop nie, maar dit beset.   Boere het onderhandel om op niemandsland grondgebiede te ontwikkel en later is Boere republieke uitgeroep en onafhanklik verklaar.   Gebiede wat aan die Boere volk se nageslag behoort.

Dieselfde tipe wetgewings gaan voort net onder ander name, aparte gebiede vir swartes, khoi san en griekwas bestaan steeds na 1994 onder trust en cpa wetgewings.

In die Hoër hof van 2008 was daar bevindings gemaak oor Chinese wat in Suid-Afrika gebore is sedert 1700, wat as inheems beskou is en wat na 1994 as swart bemagtigers verklaar is onder die 1994 wetgewings.   Op dieselfde vlakke word daar teen elke Boer, blanke en besighede wat deur die groepe geskep word, gediskrimineer, Boere en blankes wat ook inheems is in Suid-Afrika sedert 1652.  Sommige Chinese is volgens berigting deur die Kaapkolonie (Engeland/Nederlands) ingebring voor ‘n sekere tydperk, maar word as inheems beskou.  Indien hulle inheems is, is die families van die Boere nog meer inheems, van die Boere het as Vryburgers landin beweeg, en was daar ook teen hulle gediskrimineer.

Die hofsaak se bevinding sluit nie immigrante uit ander lande soos China in wat nie hier gebore is nie, tog word hulle vandag met ope arms verwelkom.    Die Chinese was nie so lank in Suid-Afrika nie, maar dit kan wel teruggevoer word na die mynwerkers wat deur Engeland gewerf is saam die swart arbeiders.  In totaal was daar ongeveer 60000 wat hier in myne kom werk het.   Daar was enkele Chinese wat ongeveer 1700 hier geland het.

In the year 2008 the South African High Court in Pretoria ruled that the South African Chinese community were “black” in terms of Employment Equity and Broad-Based Black Economic Empowerment.  This was the result of an eight-year battle launched by the Chinese Association of South Africa to clarify their status in terms of affirmative action and empowerment legislation.

It was reported during 2008 that Judge Cynthia Pretorius granted an order in terms of which Chinese South Africans are included in the definition of “black people” in the Broad-Based Economic Empowerment Act and the Employment Equity Act. Both laws cover Africans, coloureds and Indians.   No whites are included in the economy empowerment or employment equity Acts.   Even sport quotas were implemented against whites and others were fine to play the games.

The ruling is the culmination of an eight-year struggle by Casa to obtain clarity from the government on whether Chinese South African – who were classified as “coloured” during the apartheid era – qualify for the benefits in terms of the two Acts, designed to restore historical injustices in the country.

Patric Chong, the chairperson of Casa,  was overjoyed at the judgement and that Chinese citizens of South Africans would automatically qualify for the same benefits afforded to the ‘coloured’  group, post-1994.  It was stated that, although the two Acts did not specifically exclude Chinese South Africans, the fact that they were not mentioned by name led to a lot of confusion in the marketplace.

A few questions

  • Will the Department of Labour amend Forms EEA 1, EEA 2 and EEA 4 in time for the October submission deadline?
  • Does this ruling only apply to Chinese persons who were citizens of South Africa as at 27 April 1994 (See EE Regulations 1.5 “Designated Groups”?
  • How long will it take to amend all the relevant scorecards, charters etc to take into account the import of this ruling?
  • Can our skills shortages in fields such as IT etc now be easier to achieve?
  • With the influx of Chinese money and in light of this ruling, will we see more a greater demand for persons to become fluent in Mandarin? Is Mandarin not becoming an essential competency for business executives?

In a landmark ruling, the Pretoria High Court ruled yesterday that South Africas 10 000-strong ethnic Chinese community be included in the definition of black people for purposes of black economic empowerment status. This follows a 2007 application brought against the minister of labour, the minister of trade and industry and the minister of justice by the Chinese Association of South Africa, a private organisation representing the interests of South Africans of Chinese descent. The government originally opposed the motion, but in April this year withdrew its intention to fight the case. – The Times website

They have already taken over much of the continent’s economy. Now they have gone one step farther. The Chinese in South Africa were officially declared black yesterday. Chinese say : we want to be black – 16 June
Buffalo Citys Chinese community want to be considered black. Yesterday, they said they supported a move by the Chinese Association of South Africa to ask the courts to redefine them as black people. If approved, the move will see them benefiting from BEE and employment equity laws designed to restore historical injustices of the past. The Sunday Times reported yesterday that the Chinese Association would on Wednesday ask the Pretoria High Court to include their members in the definition of black people in the Broad-Based Economic Empowerment Act and the Employment Equity Act.We would definitely support the move, as we were shunted from pillar to post in the past, East Londons Chinese Association chairperson Soong-Fong Lee said. – Dispatch Online website

Die hooggeregshof in Pretoria het in ‘n landmerk-uitspraak beslis dat Suid-Afrika se 10 000-sterk etniese Chinese gemeenskap by die definisie van “swart mense” ingesluit word vir doeleindes van swart ekonomiese bemagtigingstatus. Dit volg op ‘n aansoek wat in 2007 teen die minister van arbeid, die minister van handel en nywerheid en die minister van justisie gebring is deur die Chinese Vereniging van Suid-Afrika, ‘n private organisasie wat die belange van Suid-Afrikaners van Chinese afkoms verteenwoordig. Die regering het oorspronklik die mosie teëgestaan, maar het in April vanjaar sy voorneme om die saak te beveg, teruggetrek.
