Expropriation of land – Violation of international rights


VIOLATION of the International Declaration of Human Rights.  Article 17.

(1) Everyone has the right to own property alone as well as in association with others.
(2) No one shall be arbitrarily deprived of his property.
South Africa has signed and ratified a number of similar Treaties.
Expropriation – in particular if there is a racist angle – without compensation is illegal in international law.   International Law is superior law – it takes precedence over national law.

The farmers who hold legal title to their land, will decide about the status thereof. They are tired when other role players outside the agricultural sector, want to prescribe as to what should happen to agricultural land or what farmers should do with it. Therefore, no proposal or agreement would be acceptable if the main role players have not been involved in the discussions.

This was the reaction of Mr Louis Meintjes, president of TAU SA, after the organisations took note at a very late stage of the National Forum for Dialogue’s conference scheduled for 27 and 28 March 2019 in Johannesburg to discuss expropriation without compensation.

After making enquiries, TAU SA was invited at a late stage to attend. However, TAU SA decided not to attend because the integrity of the conference is in doubt.

Their point of departure is the general statement that colonialism or apartheid resulted in land being stolen from black people. “For a considerable period of time, TAU SA supported a conference where the history of ownership of land, supported by supporting facts, could be discussed. This proposal has fallen on deaf ears, because apparently government prefers not to face historical facts which might indicate that Black people have equally doubtful claims to land”, according to Mr Meintjes. “The crated untruth that farmers have stolen their land, should now be dissected to enable us that the true history can be recorded thus enabling us to face the future without any doubts in this regard. Last weeks’ report by Moody’s stated prominently that policy certainty is now required. Agriculture has voiced the same sentiments repeatedly, but the issue affecting food production and ownership of land is growing because of doubts of government’s commitment to private ownership and the free market system. It rather seems as if a gradual shift to communism and socialism is in process.”

Mr Meintjes stated clearly that nobody has a mandate to talk on behalf of TAU SA members, or farmers who are not involved in organised agriculture. “It is ridiculous that a grouping of people could convey a conference involving the property of farmers without them being present. Nobody has the right to discuss the legitimate property of somebody, and the possible expropriation thereof’, Mr Meintjes said.

Die landbouers, wat hulle grond wettig besit, sal self besluit oor die status van hulle grond, en raak nou moeg daarvoor dat ander rolspelers buite die landboubedryf voorskriftelik probeer wees oor wat met landbougrond moet gebeur, of wat landbouers met hulle grond wil doen. Daarom sal geen voorstel of gepoogde ooreenkoms wettig of aanvaarbaar wees as landbouers nie self, en in besonder die hoofrolspelers, in sodanige gesprek is nie.

Dit was die reaksie van TLU SA se president, mnr. Louis Meintjes, nadat TLU SA ter elfder ure kennis geneem het van die Nasionale Forum vir Dialoog se konferensie wat op 27 en 28 Maart 2018 aangebied word in Johannesburg wat handel oor onder andere onteiening sonder vergoeding.

Na navraag daaroor is TLU SA op ‘n baie laat stadium ook genooi om dit by te woon.  TLU SA sal dit nie bywoon nie aangesien die integriteit van die konferensie ernstig bevraagteken word.

Die vertrekpunt is onder andere ‘n algemene stelling dat grond deur kolonialisme of apartheid van swartmense gesteel is.

“TLU SA bepleit al lank ‘n konferensie oor die geskiedenis van grondbesit, waar alle stawende bewyse oor grondbesit op die tafel geplaas word. Die versoek val op dowe ore, want die regering is skynbaar te bang om die feite te hoor, wat waarskynlik gaan insluit dat die swartes dan net so min reg op die grond het,” sê mnr. Meintjes. “Die nuutgeskepte leuen dat landbouers grond gesteel het, moet nou tot die been oopgevlek word, sodat die geskiedenis vir eens en vir altyd geboekstaaf kan word en die toekoms sonder enige onsekerheid oor hierdie aangeleentheid aangedurf kan word. Met verlede week se verslag van Moody’s was dit pertinent uitgewys dat daar beleidsekerheid in die land moet kom. Landbou vra reeds lank daarvoor, maar die beleidsonsekerheid oor landbou en grondbesit word eerder met die dag al groter, veral omdat niemand meer met sekerheid kan sê of die owerheid nog verbind is tot privaat besitreg en die vryemarkstelsel. Dit wil eerder lyk of die ANC besig is om  geleidelik na sosialisme en kommunisme te beweeg.”

Mnr. Meintjes het dit duidelik teenoor die organiseerders van die konferensie gestel dat niemand, ook geen ander landbou-organisasie, die mandaat het om namens TLU SA se lede, of die boere wat nie by georganiseerde landbou betrokke  is nie, te praat nie.  “Dit is absoluut belaglik en selfs uiters arrogant dat ‘n groepering mense ‘n konferensie hou oor landbouers se besitreg sonder om landbouers self daar teenwoordig te hê.  Geen persoon of instansie het die reg om namens iemand anders se wettige eiendom te besluit oor die moontlike afstaan daarvan nie,” sê mnr. Meintjes.

Today, there are 193 member states (South Africa is one of them) of the United Nations in Africa. Most of them have signed and ratified many of the core UN human rights treaties.

These treaties and other international instruments allow everybody to claim her or his human rights!   Including the ANC government.
