Demarcation -Afbakening

Nie net word Munisipale afbakening gedoen nie, maar ook Distrikte, Soms word EEN volk, wat voorheen moontlik as ‘n volk die meerderheid was, onderdruk en opgesny in meer as een gebied en gedwing om saam ander te val, sodat daar meer geweld tussen onderskeie volke kan voortduur. Dit het ook betrekking tot begrotings wat toegeken word op munisipale / distriksvlakke, waar daar heelwat fondse aan “geskepte meerderhede” gegee is om te hanteer. Dit kom ook voor dat net sekeres voordeel hieruit trek.

Demarcation Act  

The new Constitution, adopted in 1996, required National legislation to establish criteria for determining when an area should have a single category A municipality or when it should have municipalities of both category B and category C; and to establish criteria and procedures for the determination of municipal boundaries by an independent authority. This resulted in the enactment of the Local Government: Municipal Demarcation Act, 1998,  nd the Local Government: Municipal Structures Act, 1998.     

The Municipal Demarcation Board is an independent authority responsible for the determination of municipal boundaries. The Board’s status as an independent authority is also protected by section 3 of The Local Government: Municipal Demarcation Act, 1998, and various judgments by the Constitutional Court.

Functions of the Board

The legislation provides for the following functions of the Board:

  • determination and re-determination of municipal boundaries;
  • delimitation of wards for local elections;
  • assessment of the capacity of district and local municipalities to perform their functions as provided for in the Constitution and the Structures Act; and
  • the declaration and withdrawal of the declaration of district management areas.

In addition Cabinet approved a leading role for the Board in assisting Government Departments in aligning their functional service delivery boundaries to municipal boundaries.   

The Board’s mandate derives from:

The Constitution Of The Republic Of South Africa, 1996 (Act No 108 Of 1996).

The Board is mandated in terms of section 155(3)(b) to determine municipal Boundaries independently.

In dealing with the implementation of the Board’s mandate advanced knowledge of the relevant provisions in the Constitution, the Local Government: Municipal Demarcation Act, 1998, and the Local Government: Municipal Structures Act, 1998 is essential.

The Constitution deals with the Board’s mandate pertaining to demarcation of municipal boundaries, the electoral system for local government, and the powers and functions of municipalities.

The Board’s mandate pertaining to the determination of municipal boundaries is provided for in detail in the Local Government: Municipal Demarcation Act, 1998, and its mandate pertaining to ward delimitation, capacity assessments, and district management areas in the Local Government: Municipal Structures Act, 1998.

In terme van die sogenaamde demokratiese Grondwet van 1996, gaan die verskillende volke nie verdwyn nie, maar sal daar eerder meer geweld plaasvind. Waar een groep meerderheid is, sal dit ook die ander volke wat minderhede is, oorskadu. Afbakening is ook in die Grondwet 1996 ingeskryf. Na 1994 het daar heelwat grondeise plaasgevind, wat ook ‘n invloed het op die afbakening van grense. Immigrante en onwettiges maak ook soms deel uit van spesifieke gebiede.

Bepaling van die afbakening van Suid-Afrika se munisipale grense.   Ramaphosa het al die nuwe aanstellings reeds sowat twee maande gelede gedoen.  Dus, wie bepaal ons munisipale grense?   ANC regering bepaal die munisipale grense.    The new Board was appointed by the President of the Republic, Cyril Ramaphosa, on 01 March 2019, following the end of the five year tenure of the previous Board on 19 February 2019.

The Board undertakes three broad types of municipal outer boundary determinations where the criteria are applied differentially and the data requirement and motivation also vary.  Read with the so-called democratic constitution.

Soos met alles, gaan dit nie maklik of eenvoudig gebeur om wetgewing van die beheerde ANC te wysig of te skrap nie want dit pas nie by hul agenda van kommunisme nien en hulle is in die meerderheid   Saam EFF en DA wat wye steun verleen, sal daar dus nie maklik wetgewing verander om diskriminasie en rassisme teenoor blankes en selfs ander volksgroepe wat nie die ANC steun nie.   

Lees op hoe wetgewings verander of geskrap word.    Boonop is die ANC en EFF saam DA in beheer van meeste wetgewings. Tweederde meerderheid verander wetgewing, nie die publiek of munisipale owerhede nie.    Plaaslike en Distriksowerhede is onder  nasionale wetgewings en  verskeie wetgewings is reeds in plek.   Gaan lees maar op wie van al die multi-kultuur, fw de klerk organisasies en forums steun die 1996 grondwet en verdedig dit.  Grondhervorming is reeds deel van die 1996 Grondwet – lees Artikel 25.
