A lot of damage has been done.   To those two people, their families, farmers and business people in Coligny and even other places.   Why did this so-called witness lied under oath – to destroy white people’s life?   Who paid him?  You don’t just put people in jail because of their skin colour.    What about the real investigations, police reports, medical reports, etc?   Even if the accused were black, you must first get facts before you label anyone as a murderer. There are no proper justice system in this country and for this reason, this once beautiful country will go the same way as Zimbabwe.

Lewenslange tronkstraf staar hulle in die gesig.  Regter Ronald Hendricks, van die hooggeregshof in Mahikeng, het in Oktober bevind Pakisi het homself in verskeie opsigte weerspreek.   “Teenstrydighede beteken nie noodwendig hy jok nie, dit kan normale menslike foute wees.”   Paul Morule, ’n predikant van ’n kerk in Mahikeng, sê aan Rapport Pakisi se ontboeseming teenoor hom pla hom só dat hy nie daaroor kan stilbly nie. “Ek is ’n man van God en kan nie toelaat dat twee mense onskuldig in die tronk sit vir moord nie.”

Morule is egter ook ’n werknemer van Pieter Karsten, Doorewaard se oom, en albei veroordeeldes se werkgewer.   Morule sê sy bande met Karsten het niks hiermee te make nie. Volgens hom het Pakisi toevallig op sy pad gekom.
“My tannie bly in Coligny. Op ’n besoek aan haar vroeg in Desember (verlede jaar) het ek gesien hoe mans besig was om teëls te lê. Een van hulle het bekend gelyk en ek het my tannie gevra wie dit was. Dit was toe Pakisi.”   Hy sê hulle het begin gesels en ’n vertrouensverhouding begin opbou.
“My kerk is in Mahikeng en my plaas tussen Potchefstroom en Klerksdorp.
Ek het elke keer by hom aangegaan (in Coligny). Sommer vroeg-vroeg het hy al vir my gesê hy kry daardie twee seuns jammer en weet nie hoe om dit reg te maak nie. Toe sê ek vir hom die enigste manier is om jou hart oop te maak en die waarheid te praat.”

Hy het met hom kontak gemaak in Januarie en hom na die Spur geneem in Mahikeng waar hy n opname van die gesprek gemaak het sonder dat Pakisi geweet het.
In die opname erken Pakisi dat hy niks gesien het wat daardie dag gebeur het nie
Hy sê dat hy by sy huis was daardie dag en dat sy buurvrou en twee familielede dit kan bevestig.
Morule het hom ook na n prokureur Kobus Burger in Klerksdorp geneem vir regsadvies.Hy het aan Burger bevestig hy het gelieg.

The State called their first witness, Dr Ruweida Moorad, who is a specialist forensic pathologist.   Moorad told the court that she had conducted between 5 000 and 8 000 autopsy reports. She said she had investigated numerous cases of people who had died as a result of falling from vehicles.    She testified that Moshoeu’s injuries were consistent with a fall or jump from a vehicle. She, however, said she did not observe any signs that Moshoeu had tried to protect himself when he “jumped”.    “There were no injuries documented to the hands, his protective mechanism[s] were not employed,” she said.   She also told the court that Moshoeu – whose name means “Sorrow” – had severe external injuries.   Following Moshoeu’s death, some residents claimed he had been killed because he was black. His death sparked protests in the area, which saw a number of houses and businesses burnt to the ground.   Doorewaard and Schutte are out on bail of R5 000 each.

Coligny teenge boy suffered at least 23 injuries, court hears

Specialist forensic pathologist Dr Ruweida Moorad described the injuries as being severe, adding that Mosweu’s  right eye was swollen and he had injuries to his face.    “It is possible to get an injury like this one in an assault,” she said, testifying for the State in the matter against farm workers Pieter Doorewaard, 26, and Phillip Schutte, 34, who are accused of murdering the teen after he allegedly stole sunflowers from their employer’s field.

“The were no injuries recorded on the palm, this showed that he did not use his protection [hands].”   She also told the court due to the seriousness of the injuries, even a person with no medical background would have taken the injured person to a clinic or hospital instead of a police station.   Defence advocate Hennie du Plessis told the court they would dispute the cause of death.    According to court papers the cause of death was due to “blunt force neck trauma”.   In their plea explanation Doorewaard and Schutte said they did not restrain Mosweu in the van because he volunteered to get into the back of the van after they caught him stealing the sunflowers.

They said they were intending to hand him over to the police, but that he had jumped out of the moving van. In their plea explanations, they said left him with two people so that other vehicles should not drive over him where they lay, while they went to the police station to report the incident and call an ambulance.     The State alleges the two assaulted Mosweu and threw him out of a moving van on April 20, 2017, at Rietvlei farm near Coligny after accusing him of stealing sunflower from their employer Pieter Karsten’s sunflower plantation. Karsten is Doorewaard’s uncle.   The state further alleges that the pair kidnapped a man who witnessed the incident and forcefully drove with him around the farm in a vehicle, and assaulted and threatened to kill him if he reported the incident to anyone. They also allegedly stole his cellphone and pointed him with a firearm.

Mosweu’s death, known as the “sonneblom (sunflower) murder” triggered violent community protests that left a trail of destruction in the small maize growing town and divided the community along racial lines. At least six houses and three trucks were set alight and several shops looted and damaged as tensions erupted.

Is it that pressure that led you to change an inquest docket to murder, would it be fair to say you were under pressure to arrest the accused?” defence lawyer Pieter Smit asked him.    “I changed the docket to murder not due to the pressure from the community, but after interviewing the witness and reading his statement,” Kgorane replied.     Pakisi pointed out several locations during the inspection in loco on Monday. He pointed out where he had seen the accused throwing Matlhomola out of a van, and putting him back on the load base after realising Pakisi had seen what happened.    He also alleged that they confronted him and forced him into the load base of the van, drove him around, assaulted him, attempted to throw him into a dam and fired shots at him.

“I hope they remain in jail until they die. I don’t have a child because they killed him,” an emotional Agnes said.  He added that he would be happy if Doorewaard and Schutte got a sentence of “50 years” in jail, although it would not bring back their son.

Two farm workers accused of killing a Coligny teenager after accusing him of stealing a sunflower head have been found guilty by the North West High Court in Mahikeng.  Pieter Doorewaard and Phillip Schutte were taken to the police cells on Wednesday after a trial lasting more than a year.  They were convicted of killing Matlhomola Mosweu on April 20, 2017 by throwing him out of a moving bakkie.  The two had told the court in their evidence that the sole witness in the case was not telling the truth when he said he had seen them throwing Mosweu from a moving bakkie. They claimed instead that he had jumped off while they were driving him to the nearest police station.   
Handing down judgment‚ Judge Ronald Hendricks said he found it unbelievable that the sole witness‚ Bonakele Pakisi‚ had lied in his evidence.    “Think about it‚ Pakisi must have been very innovative to identify all the places where the incident happened. He could have easily testified about the initial place where the incident happened. This is almost rocket science‚” he said.

He also claimed that he heard Moshoeu crying and screaming: “Mama help, I am dying.”   Pakisi said he saw the accused assaulting Moshoeu and then pushing him from a moving vehicle. He said when the accused saw him, they apparently asked him what he had seen.     He said while Moshoeu lay in the bakkie injured, the accused “did nothing to assist him”.    “Accused two (Schutte) instructed me to check if the child was still alive. They also instructed me to take off my jersey in order for me to wipe his blood. They said I should lift the child but his [head] was hanging, so I didn’t know if he was still alive,” he said.

‘The police told me that I was crazy’

Pakisi also alleged that the accused forced him to drink alcohol and when he refused, he was then assaulted.    He said after drinking the alcohol, he felt dizzy and started vomiting.    “They hit me with open hands and clenched fists.
